A year’s suspended jail sentence for a gynecologist for accepting money and aiding in an abortion. No surgery
The court sentenced the gynecologist from Radom, who was charged by the Public Prosecution Service, to one year in prison, suspended for three years, for helping a woman terminate her pregnancy and confirming falsehood in medical records. The miscarriage did not happen.
Due to the nature of the case, the trial was held publicly. On Tuesday, the court publicly announced the ruling itself, without justifying it.
And the court found Swäomer and. Guilty of assisting a pregnant woman to terminate her pregnancy in violation of the provisions of the law. In the opinion of the court, the doctor also confirmed the incorrectness of the medical records and accepted a subsidy in the amount of 4,000 PLN.
Paragraph 1 – Whoever terminates her pregnancy with the consent of the woman, contrary to the provisions of the law, shall be punished with imprisonment for a period of up to 3 years. (…)
For both acts, the court sentenced the gynecologist to one year in prison, and suspended her parole for three years. The doctor will have to inform the court about the progress of the trial during this time. The court also decided to waive the financial advantage to the state treasury.
There was no miscarriage
In 2020, investigators brought an indictment in the case of Swaomir W., a well-known gynecologist in Radom, to court. As the public prosecutor’s office in Radom reported at the time, the gynecologist made an appointment with the patient for an abortion and charged PLN 4,000 for his performance.
However, the miscarriage did not happen. The woman reported the matter to the detective’s office. Immediately before the procedure, the investigator hired by the woman entered the doctor’s office, where there was also a patient and an anesthesiologist preparing for work.
The Public Prosecutor’s Office also accused the doctor of validating falsehoods in the medical records. And the gynecologist mentioned in the patient’s card that she came to him with pain, and at the same time he did not notice that the woman was pregnant.
